It is likely, however, that only inexpensive and simple measures will be reasonably practicable if the lower exposure action values are not exceeded. To comply with this duty you need to: (a) consider whether there are alternative processes, equipment and/or working methods which would eliminate risks from noise exposure; (b) follow good practice and industry standard control measures; (c) take noise into account when selecting tools and machinery; (d) maintain machinery in accordance with manufacturers' recommendations; (e) explore any opportunity to provide your employees with periods of relief from noise exposure.The HSE Guidance states "you should review your risk assessment at least every two years."Employees particularly at risk include those with a pre-existing hearing condition, those with a family history of deafness (if known), pregnant women, and young people. The Management of Health and Safety at Work Regulations 1999 prohibit the employment of anyone under 18 where there is a risk to health from noise. HSE Guidance states that "As well as special efforts to restrict exposure for such individuals an increased level of health surveillance may also be appropriate".The risk assessments should meet the requirements of regulation 3 of the Management of Health and Safety at Work Regulations 1999.In assessing suitable and sufficient, regard should be given to the work being carried out and any foreseeable loading.To be adequate, the surface must be stable, firm, of sufficient strength and of suitable composition.Activities include organisation, planning and supervision.LVAL Introduction There are 19 regulations and 8 Schedules in the Work at Height Regulations 2005. Regulation 1 gives the title of the Regulations and the date they came into force (6th April 2005). Regulation 2 deals with the definitions used in the Regulations and these definitions are given later in this Guidance. Regulation 3 specifies where the Regulations apply. The Explanatory Note to the Regulations summarises the remainder of the regulations as follows. The Regulations (a) impose duties relating to the organising and planning of work at height (regulation 4); (b) require that persons at work be competent, or supervised by competent persons (regulation 5); (c) prescribe steps to be taken to avoid risk from work at height (regulation 6 and Schedule 1); (d) impose duties relating to the selection of work equipment (regulation 7); (e) impose duties in relation to particular work equipment (regulation 8 and Schedules 2 to 6); (f) impose duties for the avoidance of risks from fragile surfaces, falling objects and danger areas (regulations 9 to 11); (g) require the inspection of certain work equipment and of places of work at height (regulations 12 and 13 and Schedule 7); (h) impose duties on persons at work (regulation 14); (i) provide for exemptions from certain provisions (regulations 15 and 16); and (j) amend, repeal or revoke certain enactments (regulations 17 to 19 and Schedule 8)." Interpretation 2. - (1) In these Regulations, unless the context otherwise requires - "the 1974 Act" means The Health and Safety at Work etc. Act 1974; "access" and "egress" include ascent and descent; "construction work" has the meaning assigned to it by regulation 2(1) of the Construction (Health, Safety and Welfare) Regulations 1966; This is an extensive definition which can be summarised as follows. "construction work" means the carrying out of any building, civil engineering or engineering construction work and includes any of the following - (a) the construction, alteratiLVAL on, conversion, fitting out, commissioning, renovation, repair, upkeep, redecoration or other maintenance (including cleaning which involves the use of water or an abrasive at high pressure or the use of substances classified as corrosive or toxic ...... ) (b) the preparation of an intended structure, including site clearance, exploration, investigation (but not site survey) and excavation, and laying or installing the foundations of the structure, (c) the assembly of prefabricated elements to form a structure or the disassembly of prefabricated elements which, immediately before such disassembly, formed a structure, (d) the removal of a structure or part of a structure or of any product or waste resulting from demolition or dismantling of a structure or from disassembly of prefabricated elements which, immediately before such disassembly, formed a structure, and (e) the installation, commissioning, maintenance, repair or removal of mechanical, electrical, gas, compressed air, hydraulic, telecommunications, computer or similar services which are normally fixed within or to a structure, but does not include the exploration for or extraction of mineral resources or activities preparatory thereto carried out at a place where such exploration or extraction is carried out. Regulation 1 gives the title of the Regulations and the date they came into force (6th April 2006). However, they do not come into force for the music and entertainment sectors until 6th April 2008. Regulation 2 deals with the definitions used in the Regulations and these definitions are given later in this Guidance. This requirement does not apply where members of the police, fire, ambulance or other emergency services are acting in an emergency.Suitable and sufficient measures shall include: Ensuring the work is carried out from an existing place of work, or (in the case of obtaining access or egress) using an existing means which meet the requirements set out in the "Existing Places of Work at Height" and "Means of Access or Egress at Height" subsections of this evaluation, where it is reasonably practicable to carry it out safely and under appropriate ergonomic conditions. Regulation 1 gives the title of the Regulations and the date they came into force (6th April 2005). Regulation 2 deals with the definitions used in the Regulations and these definitions are given later in this Guidance. Regulation 3 specifies where the Regulations apply. Weekly personal noise exposure can be used in place of daily personal noise exposure where the exposure of an employee to noise varies markedly from day to day. The HSE Guidance states that "Use of weekly exposure might be appropriate in situations where noise exposure varies markedly from day to day, eg where people use noisy power tools on one day in the week but not on others. It is only likely to be appropriate where daily noise exposure on one or two working days in a week is at least 5 dB higher than the other days, or the working week comprises three or fewer days of exposure."The need for an assembly, use and dismantling plan will depend on the complexity of the proposed scaffolding. Where this is not reasonably practicable, providing sufficient work equipment for preventing, so far as is reasonably practicable, a fall occurring. Where such work equipment is provided, it must meet the requirements of the relevant subsection of this evaluation, for example, "Ladders" and "Personal Fall Protection Equipment". Regulation 1 gives the title of the Regulations and the date they came into force (6th April 2006). However, they do not come into force for the music and entertainment sectors until 6th April 2008. Regulation 2 deals with the definitions used in the Regulations and these definitions are given later in this Guidance. Regulation 3 specifies where the Regulations apply and the following should be noted. 3(2) Where a duty is placed by these Regulations on an employer in respect of his employees, the employer shall, so far as is reasonably practicable, be under a like duty in respect of any other person at work who may be affected by the work carried out by the employer except that the duties of the employer - (a) under regulation 9 (health surveillance) shall not extend to persons who are not his employees; and (b) under regulation 10 (information, instruction and training) shall not extend to persons who are not his employees, unless those persons are present in the workplace where the work is being carried out. In applying these exposure limit values, but not in applying the lower and upper exposure action values, account shall be taken of the protection given to employees by any personal hearing protectors provided in accordance with regulation 7(2). (See the relevant subsection for details of regulation 7(2) Hearing protection.)
